" ---::: NINTH SCHEDULE vs BASIC STRUCTURE OF THE CONSTITUTION OF INDIA BY LAW ESTABLISHED. :::--- "Thursday, November 9, 2006

www.rambabu.741.com    and  http://DrSridhrRaoCentrMgmt.bloombiz.com and http://indiatalking.com/blog/rAm/1954/

"GOD GIVE ME SOME CLARIFICATION" and HE "GAVE IT".

INFERENCE :::

" It means, every law placed under Ninth Schedule can be tested under the BASIC STRUCTURE DOCTRINE.".

Who does the test than the COURT ITSELF under JUDICIAL REVIEW ?

It means every law of the LAND including every law under the NINTH SCHEDULE is subject to the BASIC STRUCTURE DOCTRINE and is in turn subject to JUDICIAL REVIEW.

The Citizen may, in his naiveness approach The Court  for any justiciable reason ( as per his thinking ), but it is for the court to see the legal and justiciable DOCTRINES involved. Hence, "RIGHT TO CHALLENGE"  by the citizen is always omnipresent  and under Article 32, even the court itself is not JURISDICTIONALLY empowered to deny him.

The mathematics and the "Set Theory" involved is very clear.

IT IS NOT THE MATHEMATICS OF VOTES or THE TWISTED and OPPORTUNITY DRIVEN LOGIC OF SOME ATTORNEYS.

It is the mathematics of pure and CRYSTAL CLEAR LOGIC.

- - - in so far as the BASIC STRUCTURE DOCTRINE ITSELF GOES AS ON TODAY. - - -.

more and important, later.
