At the same time we also believe that  laws (like 498a , Domestic Violence Act ) in its current form are not addressing the problem.

Crime against Women( Mother , sister of Husabnds) by Dishonest Daughter in Law , are not considered as crime.

Firstly these laws (498A , Domestic Violence Act ) are inhuman, as they do not allow innocent accused person to speak for their defense. Innocent elderly parents, sisters are being victimized and jailed by misuse of this law (without any investigation on highly absurd and ridiculous complaints). The abuse of this law (498A , Domestic Violence Act ) must be stopped to save Indian Family, as this law is ruining increasing number of marriages and families .

Instead of doing Justice, these laws have become tools for Blackmailing, Extortion and Harassment of Elder in-law, Sister , Distant relatives and Children.

 

 This fact of law abuse has already been highlighted by recent Judgment of Delhi High Court, WHO Report of Elder’s Abuse by Daughter– in –law, TV Programs like ‘Andha Kanoon on ZEE TV, Crime File Programes, recent Supreme Court Judgement– Misuse of 498A “Legal terrorism , Various articles by eminent and renowned writers and social workers.

Regarding the ariticle 498A, I am one of the suffered victim of the case.
We are five members in the family my father expired 14 years ago, an my elder brother got married an Agra bassed girl on 30th April, 2002. She is mentally not fit, she had psychological problem (she had one of her bua, and one of her uncle CHACHA) in her family with the psychological problem. This fact was sidelined from us at the time of marriage. and since we don't have any elder one in our family to do the investigation as my mother she is an illitrate lady and in marriage kind of issued ladies are not advices to speak too much.

we she came home for the first time we have noticed some of her activities but ingnored feeling that she is in new house so will take some time to adjusted herself. she stayed there 7 days in our house for the first time and left. After that when she came second time still her behaviour was not up to the mark. mammy had asked her if she had any prob. but she denied. after noticing these activities after a week mammy had called her parents in Agra and they replied that she may feeling had some Upari chakkar as she was taking medicine here but forget to carry it with her.

So they said to send her back to their home. we send her back to here home in Agra and after that despite of making lots of phone calls they always said that their doughter is undergoing for a treatment and when she will be well they will inform us to take her back. This situations lasts long for about 6 months and finally they told us that either u take her back as she is other wise we will file a dowry case againts u and will put all of u in behind the bars.

after that mammy had done village to talk to some elderly persons regarding the situation they assured us for help in this regard saying that if the girl is not mentally fit for marriage or having any psychological problem then he should make the settlement on whatever he had spend in the marriage as there is no point of spoiling the life of the boy.

a social meeting was arranged, they found that girl is not up to the mark and suggested him(girls father) to make the settlement and not get it ot the court. at that time he agrees and after 2 months he filled a case of downry againts us.

I know that if anybody asks the girl that what she had mentioned in the FIR logged againts us she will not be able to explain that..

as she so narrow mind... now they are trying to get maintenance fine from my elder brother.

he has to leave the co. where he was working due to 21 days of imprisionment. and now earning his leaving by doing some electrical work and generator servicing.

we have told this story so manny times to the advocate we have. but he allways said that nothing can be done the is entitled to get maintenance from the husband.

can anybody have any suggetion on this then pleas mail me if we can be saved on any ground.

Dear swarup,

I read ur opinions and courages advices and really appreciate. My self vijay Prasad I married to a Patna Based girl and without dowry because it was a close relationship from my Mother's side. i married to this girl just in the pressure of My Mother as I have the only brother of 5 sisters. I'm diploma Mech. from banglore and never stayed in Bihar. I"m staying in Delhi since last 10 years and before this I was in Banglore. I refused my girl friend to marry as, i didnot want to hurt my parents. Can you imagine I'm six feet tall with atheletic body and my wife is 4-1/2 feet small with exactly bihari features. I tried to adjust with her but could not because she is living with her parents since last five years as she cannot adjust with my parents , she canot wake up early in the morning .she cannot prepare too much food for all family members and also she feels more comfortable in patna as it is a very advance city than any other place in India etc. Her father proposed me to settle down
at Patna with them which i refused and result my parents have been arrested in 498A in Buxar and I'm tring to look for anticipatory bail . as i'm here in Delhi. Also I lost my left eye in a serious eye accident on Diwali night of 2003. i was lying alone in the Guru nanak eye hospital and had to go to two major surgeries. But My wife didnot come to see me, when I needed her best. I filed divorce case in april 2004 and afterthat they filed 498A. Now as I just started my career again here in Delhi after that accident, I canot go to Patna to get arrested myself as I can loose my job here. Also whatever i earned before I spent that in my accident so I'm financial tight also. Can you tell me how court treat in Patna in 498A. also how can I know the status of my case. Please give me advice.

Thanks for sending periodically the resources/information. Appreciate it your efforts. My family too has been victimized by falsely implicating due to misuse of Section 498-A IPC, where police too are abetting the crime by not doing their duty. Due to the false complaint lodged of my estranged wife (we are living separate since 18 months), the police without investigation arrested my ailing mother and a handicapped sister (having polio) in end-April; this resulted in death of my father due to heart attack. Not only me, my mother and 3 sisters were falsely charged and imagine our plight that myself and my two sisters living in Dubai couldn't travel to attend our beloved father's funeral in Bombay, as we were told we will be arrested at the airport and we wouldn't be able to go back to our jobs in Dubai (UAE) for 2-3 years till the case is over in court. We have employed a lawyer and trying to deal with the case matter.

We have had similar tragic experience in my family. The girl who is
married to my son ran away within a few weeks after the marriage with
anotehr married man from her howm town. She was lcoated in hotel a fewdays
altter but was not handed over to the police. She harassed us enough
with section 498 A. I came to know that this is in fact business in some
cases. I do think women need protection but I also think this should
not punish innocent men and put them to torture. Such women should be
dealt with seriously and there should be proovision to reopen all cases of
such harassment by women of men so that in future women will not mis
use such laws.

With due respect,i would like to bring to your kind notice the PLIGHT OF INDIAN MEN.yes,its about the men who are suffering at the hands of the females.in this day,when all the light is being focussed on the security and safety of women from the barbarious males on spree of raping and molesting the females,no one is bothered about a very small chunk of males who are being harassed by their wives and her family.there have been instances when the girl and her family have filed a false Dowry harassment case against her husband and his family members.take for instance the case of Major K S Gill and his family.as reported in The Times Of India 2 weeks back,the dowry harassment case against him and his family members by their daughter-in-law was found out to be seemingly motivated and eventful by Honorable Additional Sessions Judge,Shri Narottam Kaushal.i know this Major personally and also know how everything has been fabricated against him and his family.this kind of cases are being filed too frequently now just to gain some or the other benefit.

i wont be taking any names but one of my very close relatives is also undergoing the same trauma.he belongs to a very reputed family in a town of north and works in the armed forces.wont be telling you the force.he was married to a female from the same town 2 years back,and it was an arranged marriage.just few days after marriage,the girl started throwing tantrums that she was married against her wishes and that she did not want to get married.after much pestering,she stopped throwing tantrums but she and her mother used to do create one or the other confusion in his family.he was most of the times on his posting as his job required it.this female and her mother took advantage of this and created all sorts of problems.later when she went with her husband to other posting,she started spreading rumors that her husband was involved with some other female,her in-laws have tortured her a lot and many more things which was not true.i know this because i have been witness to nearly all this.for past 1 month,she has been staying with her family because she doesn't want to stay with his family moreover,the guy and his family fear for their lives as she can stoop down to any level because they have seen her past actions.now her family is threatening the guy to keep her according to their wishes and many other conditions or else they will file for dowry harassment case.the biggest surprise of all this matter is that at any point of time,neither the guy nor his family members had or have demanded dowry.his family is much well to do with his father being a government officer,he himself a reputed person and his brother and sister well settled with their jobs.the girl's father had given a car and many other things in-spite of repeated requests that these things were not needed as they had everything.now the girl's father is threatening o take legal action.the options left with the guy are-

1:he keeps the girl against his wishes with fear for his and his family members life

2:they go in for an out of court settlement,which could be exorbitant considering the fact that the girl and her family are very greedy

3:they go to jail.now considering the state of affairs and all the kind of law this is,they all will land in jail,and bail in this case is very difficult if not impossible.the onus lies on them to prove that they are not guilty.the girl and her family has no problem whatsoever with anything.

suppose out of pressure and force and to avoid all these court proceedings and our not so friendly police force,the guy keeps her with him and then one morning we come to know that he has been poisoned or he has committed suicide,then who is to blame for this???

All our ministers and Women Welfare Organizations talk of upliftment of women but who is going to look into this matter?our judiciary and police are pro-female then where should these harassed people go?in today's date,all protection for women is required but who is to be blamed for all the misuse of such laws?women demand equal rights and they should have it but why this step-motherly treatment with guys when it comes to dowry or other false implications?not all dowry cases are true,not all in-laws demand dowry,not all in-laws are butchers and devils?they are also human beings then why such discrimination??

I have written to you with the hope that this matter is brought to the light of people.

I'll be highly obliged if you could forward this letter to concerned people,people in judiciary,women welfare organizations,esp Shrimati Brinda Karat and concerned ministries.

From whatever I have recently learnt about 498a from the columns in this
site, leaving apart all its current impacts and raminifications, it is a very
bad law based on presumptions, unfit to have been passed in any civilised and
democratic society. The provisions are barbaric(almost Gulag Like) and fascist
in their arbitrariness and onesidedness. They are clearly the result of a long
drawn out conspiracy hatched abroad against the Indian society through well paid
collaborators in India. It is a conspiracy to destroy the family units in India.
Hence there is little scope for any improvement in such laws. Even the Supreme
Court has spoken.

This law needs to be repealed lock stock and barrel. A totally new law needs to
be enacted, which decriminalizes family relationships. Family courts can be
established to take care of any discordant acts within the family when brought
to their notice. There are enough laws on the books on crimes such as of murder,
extortion, fraud, blackmailing, threats, perjury and violent acts under IPC,
that should take care of the crimes that are intended through 498a.

Once dowry has been declared illegal, laws need to be enacted to define
precisely, what constitutes dowry. Marriages need to be registered to define
any special provisions in the marriage mutually and willingly agreed to by both
parties within the provisions of the law. Violations of those provisions should
be punishable after the violations have been proved.

What appears surprising is the silence of the major political parties. How such
all-encompassing social issues can be left to the games played by NGOs? Are they
not aware of what is happening to families through this law? Were they
blindsighted before they passed such a fascist law, or were(are) they also being
bribed by these foreign funded organisations? These laws and the consequences
that are being published in these columns should have been enough to wake them
up.

How is it that the women's organisations do not care about the welfare of the
women themselves? It is obvious that the objective of these women's
organisations was not the welfare of the women, but destruction of the family
system of India by letting loose women against women, young immature girls
against the men in their lives, and use the discordance created thereby to mint
money and influence for themselves, socially and politically. Destruction of the
family units in India will thus make India vulnerable to foreign cultural
influences and also make India militarily weak at the same time. Only enemies of
India can plan such a move. Who are they? What is happening today was
unimaginable even a decade ago. How has the Indian society been caught napping
against such enemies of India? These are the questions that need to be raised
and answered Madhuji. It is certainly not as simple as you sound to be.

Now that the society has awakened to the enemy within, it is time that all those
who are trying their best to save it, are supported and not belittled or
countered.

I did exactly what u have mentioned .Now my parents visitd twice to
CAW cell ,and that SI is blindly supporting my inlaws.I feel my self
very ashamed and feel sorry for my parents whenever i hear that my
inlaws abuses and threatened my parents infront of SI.
In two visits of my parents i have understood that they have plan to
harras me and my parents so that i continue to give their daoughter
a monthly amount + other pending amount for electricity,pregnance
etc etc and they want their daoughter should remain my wife. They
are threatning my parents that we will file cases against you all.We
have approach to Chief minister can call him anytime we want etc etc
I have decided to spent money to fight with them legally .Parally my
lawyer making a chrgesheet against them plus giving a request to DCP
for my parents security because my inlaws can go any extent.

what is 498A it was not known to me,now i have come to understand
through this saveindianfamily site.Thanks to Dsouza to make me aware
of this site/group.
now I am also from delhi and ready to get involve to give your team
little support from my side .I Conjure all NRI/Indian husbands to
come forward to help such type of organisation working in this
connection either financially or giving a physical involvement to
save our Indian brothers and their families of either religion from
these ravans and supernakahs.
Fisrt I would like to suggest you to make aware of 498A to our all
brothers in all over the world though forwarding a mails and making

we should give the subject for that mail in such a way that no one
is supposed to drop in the trash.as soon as he opens and read ,we

This is understood that we are trying hard to get the good jobs
after gradution making ourselves financially strong and then getting
married supernakahs to spoil and play with our career.If we all get

I WAS IN AMERICA AND BLESSED WITH A SON OF 6 MONTHS AT THAT TIME. THE ORDEAL STARTED WHEN HER PARENTS AGAIN AND AGAIN PRESSING MY WIFE TO SEND MONEY AND TAKE HIS SON TO AMERICA. AS I AM NOT AGREEING.

FATHER AND MOTHER RS. 25.00 LACS.

HER BROTHER, FATHER AND ALSO TRY TO PICK-UP MY FATHER FROM MY HOUSE IN DELHI WITH THE HELP OF PUNJAB POLICE AND TAKE HIM TO PUNJAB WITHOUT INFORMING THE LOCAL POLICE STATION OF DELHI. MY BROTHER AND HIS WIFE RUN FROM THE HOUSE WITH THE HELP OF LOCAL PEOPLE AND DIAL 100 AND LOCAL POLICE STATIONIMMEDIATELY THE DELHI POLICE CAME AND PUNJAB POLICE LEFT THE SPOT AND THEY TOLD DELHI POLICE THEY HAVE COME TO GIVE ME THE SUMMONS.

THE PUNJAB POLICE LEFT WITHOUT PICKING MY FATHER DUE TO
DELHI POLICE. THEN MY FATHER WAS THREATENED IF HE COMES TO PUNJAB AT HOSPHIARPUR HE WILL BE KINAPPED. MY FATHER WITH THE HELP OF PEOPLE TRY TO CONTACT THE PUNJAB POLICE THEYINFORMED THAT THE CASE IS NOT REGISTERED SO THEY WILL NOT ACT.

MY WIFE THEN MADE COMPLAINT IN THE WOMEN CELL AT DELHI UNDER 489A AGAINST MY BROTHERS TWO, BHABIS TWO MY MOTHER ANDMY FATHER. THEY TRY TO SEND SUMMONS TO ALL AND TRY TO PICK UP MY BROTHER WITH THE HELP OF POLICE BY BRIBING THEM.

THE PROBE STARTED SHE USE TO GIVE THREATNING CALLS TO MY FAMILY AND ME AND ALSO SEND LETTERS THAT I AM GOING TO KILL THE CHILD. I USE TO SEND MONEY FOR CHILD MAINTENANCE.

THEY DEMAND MONEY FOR SETTLEMENT. FINALLY THE CASE IS RGISTERED IN WOMEN CELL. THE PROBE STARTED THEY USE TO HARASS BY FATHER AND MOTHER AND BROTHERS ON BAIL DAYS. FINALLY WITH GREAT DIFFICULTY THE BAIL IS GRANTED TO OUR FAMILY.

MY FATHER DIED DUE TO GREAT HARASSEMENT GIVEN BY MY EX-WIFE.

I HAVE TAKEN DIVORCE FROM THE COURT BECAUSE SHE IS NOT RETURNING BACK.

NOW I AM IN INDIA THE COURT CASE IS GOING ON. SHE HAS MARRIED TO RICH MAN OF NORWAY SHE HAS LEFT AND GONE TO NORWAY. BUT MY FAMILY IS FACING ORDEAL AT HER HANDS AND HER MOTHER HANDS. HER MOTHER CAME TO COURT AND ALWAYS TRY TO HARASS US ON ONE PERTEXT OR ANOTHER.

SIR, WANT CAN I DO :

It's Time To Stand And Be Men Again! (slightly edited)

As men we have been insulted, put down, lied about, analysed,
wounded,
investigated, financially ruined, assaulted, humiliated, and
emasculated by
females for long enough. We have born it with patience in the face
of
outrageous pressure. We have seen our children snatched from us and
given over
to vindictive women. We have been told to pay for the upkeep of
children we
have not fathered and been forced to pay for kids we cannot see. We
have seen
those kids lawfully kidnapped and we have buried them and too many
fathers when
they have killed themselves. Grandparents, uncles and aunts have
been denied
contact with their grand kids, nephews, and nieces.
Our streets teem with out-of-control and fatherless kids in our new
world of single-motherdom. Children with no discipline and a
succession of part time daddies are growing up confused and angry.
Kids are downing drugs like sweets. They are smashing
things up that belong to all of us. They are stealing, drinking,
fighting and dying on our streets like never before. Kids who love
their fathers are being programmed to hate them by vicious women who
themselves are programmed by government and radical feminist
propaganda. Judges are deaf to our cries for justice and the media
is run by politicians who meet editors on golf courses and tell them
to tell us what we are allowed to hear. Television is saturated by
radical feminists and the men around them are too cowed to argue.
Now these paragons of the "gentle sex" are beating men in their
homes like never before.
Enough is enough!

This is a war but it is not one we started. This war was started by
radical feminists. When feminists said they wanted equality we
supported them. Women have a right to equal pay for equal
work. "Good luck to them!" we cried. When they wanted equality in
the Workplace we said, "Yes, they deserve the same opportunities as
the rest of us." We supported every move they made and we changed
our attitudes accordingly. That should have been the end of it.
Then the radical feminists rode over the hill. They did not want
equality, they wanted revenge. So paranoid are these vicious and
really rather stupid people, that they see any criticism of any
thing they do as evidence of men trying to control them. What I find
most interesting about them is that when I analyse the techniques of
male and female abusers I see exactly the same behaviour in the
abusive individual as I see with the entire radical feminist
movement. Abusers are just a microcosm of the whole radical feminist
movement. Like all female abusers, what they are really doing is
projecting their faults onto men.
Their influence over politicians is terrifying. On the one hand
there are the politicians who support everything they say. Then we
have the politicians too afraid to speak out in case they are
blacklisted by these creatures and their friends. Didn't something
like this happen in 1939 in Germany? Isn't this how Stalin operated?
Did not the States in Eastern Europe do this kind of thing? Is this
not what millions of men gave their lives to stop in countless wars
from Europe in two world wars, to Vietnam and, more recently, Iraq
to stop? This creeping Marxist political nightmare has to be halted!
Using men's natural fear of shame and of upsetting women, the
radical feminists
have stampeded across the world with impressive speed. It is time
for men to get tough with this bunch and if the politicians will not
do it then it is up to us. The radical feminists have started a war
that is destroying the emotional, mental and literal lives of
people -- usually, but not always men -- all over the world. Their
acolytes turn up everywhere. They are, for instance, all over TV in
the western world like a rash.
The constant refrain we hear from them is that men are all the same.
Thank God that that lie is self evidently false. Other lies are not
so easily fought, though. The idea that all men are rapists and that
is all they are (one of the rad-fems' favourite quotes) is a sick
and distorted view, sure, but it is one that has found favour with
an unthinking bunch of young middle class woman and caused them to
view everything male with deep suspicion and even hatred. They then
teach this hate to their daughters, and false accusations, domestic
violence against men, and hugely sexist and discriminatory practices
against men are now common place.
The radical feminists have declared war on everything male. It is
now time for
men everywhere to stand up and fight back. Not with violence and
lies but with the truth. When they cry that we are aggressive
brutes, let's remind them that we did not start the fight. When they
try to silence us on the Internet, accusing us of hate crimes, let's
throw all those quotes we have of their hate in their faces.

They are about to make a huge mistake. They are going to try to shut
down our web sites by dragging us through the courts. The government
in Canada have given them a huge sum of money to finance it. GOOD!
In court we can shred them. We only have to show the judges the
reality of radical feminist propaganda and the hate crimes they
have been committing against men for years. Like the web site called
S.C.U.M. Better known as "The Society for Cutting Up Men." If you
have not started to collect this filth yet, now is the time and the
Google search engine can help you do it.
How are we going to wage this war? Where are our troops? What are
our objectives? What are our weapons?

Where are our troops?
Our troops are already in place and they are being added to daily.
They are the men who are members of all the men's groups world wide.
They are all the furious grand parents, brothers and sisters who
cannot see their relatives. They are all the men who have been
ripped off in divorce settlements. They are all the fathers who have
been cheated in family courts and by organisations like the Child
Support Agency, here in England. They are the growing body of men
who are being beaten by their wives and partners in the home. They
are the pensioners that have found their life's work is worth a
pittance because some fat cat has ripped them off. They are the men
who have been forced to pay for child support for kids that are not
theirs. They are all the guys who have been falsely accused of rape
and other sexual offences by sick women with a grudge. They are the
women who are sick and tired of the feminist bullshit that says
their sons are worthless scum and their daughters are just simple
helpless victims. There are the gay victims of domestic violence.
These are our troops and there are millions of them!

What are our objectives?
Our objectives are many but also simple. We want our families back
and free from the control of government. We want our kids to know
both their parents. We want those men who have paid out huge sums
for kids that are not theirs to be paid back and we want
compensation for those who also suffered the loss of their jobs. We
want men who have been put out of their homes unfairly to be
reinstated or compensated. We want refuges for men and their
children to go to when their partners are violent. We want the
family courts opened up to proper scrutiny or got rid of all
together. We want the CSA to be scrapped. We want the press to print
our stories. We want female paedophiles brought to justice instead
of excused, so our sons can be protected from these female
predators. We want an end to women-only services and clubs. We want
equal health care and retirement ages. We want an end to sexist anti-
male state laws and legislation. We want victims of domestic
violence to be seen and treated equally as people and not in terms
of their gender. We want equality for those in jail, which means
being able to see their kids and being able to wear their own
clothes. We want an automatic right for fathers to see and care for
their kids when relationships split up, unless it can be proved that
the father is unfit. We want the ability of unmarried women to leave
the country with our children
repealed. We want the normal rules of evidence applied to domestic
violence cases and we want the police to take men's complaints
seriously and act on them. We want to hold the people that robbed us
of our rights or were complicit in that process to be tracked down
and held to account. We want corrupt judges to be prosecuted and
jailed -- not in some cushy, open jail, but in real prisons, as a
warning to the rest of the judiciary that the people place them in
positions of trust and it's a bad idea to abuse it. We want women
who claim maintenance from men who are not the fathers to be sent to
jail for fraud and
for malicious intent to obtain money by deception. We want those
found to be making false allegations against others in court to be
sent to jail for a mandatory 5 year term or for the length of
sentence that was, or would have been, given to the accused --
whichever is the greater. We want social sanctions and benefit
sanctions imposed against single mothers until they stop using men
as sperm banks and walking wallets We want serious and ongoing
research into all aspects of female violence and we want it
published. Above all, we want females to take responsibility for
their actions and all the excuses handed to them to end. And..., if
the radical feminists and their political stooges don't like it,
they can sit on it!
What are our weapons?
Our weapons are simple. The truth!

How are we going to wage this war?
We must make our presence felt all over the world and in a hugely
coordinated way. With today's technology on the Internet we can hold
private conferences with the heads of every men's group with an
Internet presence in the world. Our strategy should call for huge
combined protest actions that are co-ordinated from a central
control point with sub groups in each country. Demonstrations both
small and large should occur in a combined way. We need to take over
the dominance of the press and drown out our opposition with the
sound of our own arguments. We need to organise the talents within
our various groups and get them working together with others in
other parts of our own and other
countries. Television stations must be bombarded with requests for
interviews until they cannot ignore us any more. Files showing the
hate crimes against men, such as radical feminist quotes and
cartoons, need to be copied and shared with every other group in the
world so that in courts we can rip these vermin down to size. Huge
public walks as well as individual efforts can be undertaken to
educate the people so that they back us. Without the backing of the
ordinary people we will fail.
Sports championships need to be invaded by our supporters so that
cameras all over the world will see what we are doing and saying.
Indoor events like the opera and ballet can be disrupted with
peaceful but pointed protests. Tennis events like Wimbledon and the
Davis cup would be natural targets. The religious among us might,
for example, parade a man dressed as a builder strapped to a cross
and carrying in one hand a trowel and in the other a fake brick with
the words, "They killed the Son, now they want to kill the fathers"
written on a sign and hung around his neck.
We must prepare and agree our alternatives to the current
legislation such as the family court system and the sexist laws like
the "Violence Against Women Act," in the United States. Above all,
we must shelve our individual egos and let leaders lead. Backing
them to the hilt and making huge concerted efforts to raise money so
that they can fly around the world putting our cause to the people
of every country infested with the radical feminist lies. To do this
we need to drop any inflated views we have ourselves and our
abilities. Natural leaders will emerge once we become organised.
Chief amongst our realisations must be the knowledge that we must
act, and act now! There is no more time to mess around with silly
little uncoordinated protests. The time to fight and to organise is
now! The time to gather our army is now!
Not when our enemies are ready, not when the government is ready,
but now, when we are ready!

I dont know your name but can you pls tell how did you guys survived
for five years .what situation your parents faced out there in india?
Your case has been over or not?did your inlaws ,including CAW cell
tried to call you back in india.did you approach to indian embassy
where u r now .
Yesterday my parents along with our lawyer .went DCP , ACP an
launched the complaint in written against my inlaws and also met
with HOD of womncell.She said we can help only when you call your
son here or submit the employment contract copy to us to show his
wife. For this we can delay one week to register the case.she said
we also dont want to spoil his career.But like you are running here
and there .They are also getting relaible sources to put pressure on
us.
Our lawyer said since the case is not yet registered by the CAW
cell so it is not advisable to take the anticipatory bail in
advance. this itself will then show that we are culprit.so,we only
can take A. bail when the case is registered. and also before taking
a A bail we should make some ground to have it in future when it is
really neede for all family members.
Also I met one attche (labour & cousular) Indian embassy
kuwait.he assured me that no one can call you from kuwait here as we
are here for NRIs and not to investigate them or harrass them,you
concentrate on your job only.you write one complaint againts your
inlaws and give to us that application we will forrward to india to
the responsible person to frther investigation .This application
acknowledgement also we will give for your future record.

I write this with the great emotions that only in Ravans
family you can find supernakhs not in Rams family.Rams/honest family
will never go for False allegation or misuse of 498A ,they always
will try to get settle down their family matters among their
elders.I also feel that the real victims in Ram family are still
quite far away from being use f this law.So, I think this law
ipc498A has been implemented only for supernakhs and ravans families.

Antciprity bail and protection , till date we had got from court , by urguing this point only , as soon as the FIR registered the police will arrest of all and the family will be broken , LAW is for givign the justice and find the truth , not to break the family!!!!!! The purpose of the 498A --- is to break the family ?? Let the Judge give the answer and accept yes 498A made to break the family !!! Very interesting .. no judge will be able to say this sitting in the Chair !!!

Before they term you criminal , you have to term them as criminal in front of LAW . Yes for them it is like two line complin , but for you required a strong action plan .

Further , you can file a writt petition to high court against the CAW cell , mentioning that they have not taken your evidence during investigation , let the court instruct the CAW cell to take your evidence and then only decided the case is false or true ... law is a vast area .. need innovation , exprement .. knowledge .. till date all the laywer are going through the standard procedure .

Save institution of marrige , let the FIR registered but protect the citizen from arrest as there is noting serious crime . 498A a family killer . That is the reason RCR instead of divorce petion is more effective to achieve our targets . In front of LAW , you have to show you are a innocent want to take all the responsibility of a husabnd , but she dont want to take the responsibility of the wife and mother . Let file the child custedy , let them keep near by court for the rest of the life and when the child became adult , say i tried for last 18 years , before you born to take you with me ( yes some guys filed the same befer their child born , with a aligation she want to kill the child , save the child) , but those suparnakahs and Ravans not allowed ... he/she will never ever forgive those Ravans and Suparnakahs , the day he/she will see all your petition , this is the real punishment for them , which is worst than 3 or 4 years jail .

Yes til date 98% laywer will advice you , wait and watch and then when you really get stuck , then pay them huge sum , make a compromise with huge settlement .

First battel in 498A , they will try to arrest you , you have to fight for not getting arrest , Lower court , High court , supreme court are there ... if you failed every where , then only surrender ... let supreme court say .. 498A made for killing the family ... so we have to arrest them for investigation , with out arrest investigation not possible !!!!!!!

This was clearly stated by her dad's brother Mr. Sai reddy a retired DSP from the Andhra predesh, who has been going around with a few cops threatenning women folk in my family and freinds. Please adive what my next steps should be and how I can prevent this harrasment by the cops.
The inlaws are calling me on a daily basis and harrassing anyone and everyone whos related to me , and they are shamelessly mentioning to us that the sole purpose is to extor money and torture our family 'cos I didnt give in to their demands. how do I get this into public attention. My best bet is go to the papers with this and get them out in the public with names and photographs. Please suggest how I should proceed.

Hi,

Yesterday my brother's wife's lawyer sent a court notice in which
they have filed case under section 125 which is basically a criminal
section under the family court seeking mainteinance..under which at
times even before any decision is taken the boy's family has to
start paying mainteinance and court charges to the girls' family....
We had sent them a court order of Restitution of Conjugal Rights for
which they never replied back instead sent this court notice....Not
only that they have made false claims regarding my brother's income
and are now seeking maintenance for my brother's wife.....I don't
understand does my brother need to pay maintenance even before
divorce??...Also they had attempted to file a false dowry case which
they could not so far becasue the inspetor in the mahila thana got
the proofs that they were lying....The version of the story that
they have sent in their court order now is different from what the
court notice they had sent before and also from the complaint that
they had lodged in the mahila thana...What action can we take??
Please help.

Wife has filed false 498a in Chennai.
Her parents have used influence of police.
Police did not follow any protocol.
Arrested my mother & sister, and kept them behind bars for 8 days.

Married over 5 years, and have a 3 yrs old daugheter.
I live in US, and am in no position to travel back at the moment to defend the case.
My wife has also filed for a divorce petition seeking 90 lacs.

Need advice
1. Any suggestions on how to get insights on court-based settlements on monthly alimony & child support ?

2. Emotional Counselling for my mother who is a widow, and is extremely depressed by the incident.

The case was falsely registered by corrupt Police and FIR filed
having cooked up story.

There was no investigation or enquiry by Police at all.

Charge sheet was filed by Police without any investigation report.

Police has given Two different versions different from original FIR in proceedings and remand application.

Complainant has now admitted in proceedings and signed the
document that the Complaint lodged by her was false.

The matter is nearing end in court.

The documentary and other evidence has also proved that this case
under section 498A of IPC was a legal blackmail and extortion carried
out in collusion with law enforcing machinery in India.

The matter has been taken up with Ministry of external affairs in India.

There is no response in respect of petition sent to President of India by me.

Matter will now be reported to US authorities also.

Mr. Swarup may refer this case to SAB T,V.....I will provide all the details
along with documentary evidence and all the help required.

God bless people like you, certainly.........who fights for real and sincere cause India is facing today.

My own research: I made research on middle class and bit high middle class educated families in my friends, neighbourhood, relatives families... to my strange discovery. I noticed that, in majority of the families, around 75%, husband are either dead, very weaker, disease proned, physically looks very older than their real age.

I too believe strongly in what gorky said, INDIAN MEN ARE REAL FOOLS and devastating health, by supplying everything to their family blindly, whereas they are not taken care of, by themselves or their own family sincerely...

I think the wirter ( SWAGATO GANGULY) does not have enough knowledge of the 498A . So let the writer go and search in the internate misuse of 498A , before writting such article . How you keep such type of dumb jurnalist in your well maintened news paper ??

This is a only IPC against which supreme court of India described as Legal Terrisom . In the History of last 60 years Supreme court never ever used such strong ward agaisnt TAD/POTA or any other IPC.
The word , reltive , mental harrasement are the main problem. And at last there is no punishment when it proved the alligation is wrong .
How you can justify when a 28 years young women complin against a 65 years old women for mental harrasement ?? Do you know the WHo report , the bigest problem in India is the elder abuse by Daughter in law ?? Is ther any law by which you can punish when a dishonest daughter in law abuse their in laws ??
If the LAW is against men , then no problem , because as a Indian men we belive to sacrifice our life towrds the well fare of women . Do not put all 600 million men in the same bag . Raja ram Mohan , Iswar chadra Bidha sagar was also a men only , who had given the well fare of women .
The problem starts when a daughter in law start threating to thier husband family that she will put all the realtive behind the bar by a single complin , if her illogical demand not accepted , like adulterity relationship , sowry demand , refused to stay in joint family , abuse the husabnd if he talks and visit to thier parents and sister ?? What do you feel , we dont have any responsibility towards our mother and sister , after marriage we have behave as per instruction of our dishonest wife ?? A self respecting , belive in hard working , will never ever use the 498A ( Modern Sita ) , only those dishonest , greedy , money minded women ( Suparnakahs and Ravans family ) , will misuse this 498A to extract the money . Marriage is a civil contract , a mother who had made all her responsibility upto 60 to 65 years , and now one day some pwoer baby comes and term them as a criminal .. how you justify that ??? Crime is crime , punishment should be as per crime , not by gender , then only actual criminal will get punishment , other wise the innocent will go to jail and actual criminal will move free in the society , as a result the women sill get killed more and more , women will be raped more and more , as you have allready decided that every years you must send some predetermined innocent behind the bar with out any investigation , so that your statistics shows that there is a lot of crime against women , today all women orginsation teach how to spoil the marriage , any orginasation is there who teach how to improve the marriage relationship ??? .
In case of TADA/POTA also your relative will not be punished , but in 498A all your age old parents and sister , daughter of the your sister will be behind the bar .
That is the reason this law misused so heaviely and if you check the court record 98% case end up as a blackmailling and extrotion of money . Will the law to extrotion of money or punish the criminal ??
What about sowry harrasement ???
There should be some fair principal in any law , let make a 498B agaisnt dishonest daughter in law who abuse our age old parents and sister !!! Why our mother , sister are not women ???
So first check what is 498A before writting any article .

Hi,

Here is my story and I need help and advice.

I went to India and got married to a girl selected by my parents (through newspaper arranged marriage). After both of us came to USA things started changing. She was very abusive, she would run out of the house at night, throw stuff around in house and at me. Shout at me at the peak of her pitch (even at night and awake neighbors). She would get angry for no reasons and was very unstable. Will get violent for no reasons. As a matter of fact she also got arrested for domestic violence. Both she and her mother tried to get me arrested by giving false statements to police but that didnt work.

This is the point when I took stock of the situation and came out of false hopes. I filed for a divorce petition here in USA. Here mother went back to India and tried to call our relatives and by giving them false information tried to create animosity and figh in the family which didnt work at all for her. Then she send a letter through a lawyer that we should take back the divorce case in India or else they will file a 498a dowry case against us in India. Since we didnt take back the case in USA her mother filed false FIR in police station stating that we demanded dowry from them and tortured her daughter in USA. It is hilarious that she has to go to India to make all these false claims (as it didnt work for her in USA). My parents got their anticipatory bail in India. Although they didnt get it for me since I am abroad. My divorce case in USA is near settlement, and I should be getting my judgement soon. We were married for 8 months before I filed for divorce. Please suggest what I should do now? Should I get my divorce legalized in India. How do I fight the false 498a case? What can I do to protect myself? What cased I can file against them to prevent them to try things like this in future against other poeple?

Mumbai Meeting No.1

A Sunday that no one would have wanted to quit home. A Sunday which everyone would have wanted to spend watching Gauri Ganpati Visarjan. A Sunday if nothing at least one would have spent lazing around and enjoying the untamed versions of Mumbai rain. But, as the saying goes "there is never a wrong time to do the right thing". And hence the most desired meeting took place with quality people.

The day was apt, and so was the bus, which was boarded. Courageblue1 and myself were to board it from W.E Highway and guess what!! we got in to a bus with a route number 498, that led us to the desired destination of the meeting. Six battered husbands and 1 sister of a victim attended the meeting. Gokul and courageblue1 drove the proceedings along with Bluewolf.

The stories of all the victims sounded tragic.

Being a male problem no tears were seen but yes clouds occasionally wept. All the victims ostensibly were down to earth people from a sound middle class background and values of the highest esteem in the society. Empathy was in air, so was helplessness. But the hopes and convictions were high and so were the intentions. The interruptions of the rain in the open to air cafΓ© resembled the hurdle that each one of us are facing. But the morals were high and we were searching the silver lining to the cloud.

The ball has set to roll and the consensus was to carry on helping each other and repeat such activity. At the end with maturity as the undercurrent and helplessness as the overtone, the meeting was curtained it was understood as pointed out by one of the members that men don't speak even after they have suffered, they just laugh it out on themselves, but seriously "We now no longer can be reduced to a Laughing Stock, as sisters and parents too are involved." And hence a lot needs to be done.

And that is why with quality people we are sure to get more people participating and not shying away.

Prayers for all those stuck.

My younger brother DINESH got married on 30th Jan 05. His marriage was arranged through a marriage broker and was with the full consent and participation of elders from both sides, but as we were in a hurry to formalize the marriage we did not make any extensive enquiries either about the girl in question, her or her family’s background and mostly relied and accepted the Marriage Broker’s inputs.

My brother left India (as he was on a limited period of leave) on 21st Feb 05 to resume his job in Dubai. Ms. NISHA, my sister in law as is the normal practice in such cases stayed till 23 March 05 stayed in our house with our parents. During this period her father unfortunately fell ill reportedly with a mild heart ailment (as informed to us), so my sister in law with due approval of my parents , went and stayed at her parents house for a week to look after her father in his time of need. When she came back from her parent’s house after a week, her behavior which was normal previously suddenly altered for the worse and she started quarreling with my aged parents and elders sisters for no reason and without any provocation. Prior to this there was no indication of any dissatisfaction from her side and during all telecons with her husband her constant refrain was that she wants to be called to Dubai at the earliest , which we considered the normal desire of any newly wed and were in fact in the process of expediting her visa formalities.

We tried to improve her behavior through various phone calls made to her but to no avail so finally we included my sister in law’s parents into the problem and made a call to them on the morning on 23 March and briefed them with a request to interfere and ensure minimum behavior expected from a daughter of a decent family married into another decent and educated family. Her father assured us, that he will take care of matter and ensure that his daughter will not misbehave in future (in fact he profusely apologized for her indiscretions) . We trusted him and thought that matter had been amicably resolved, but both daughter and father had planned for something else and more drastic and deceitful. On the same afternoon, when my aged and ailing mother was alone at home and resting after her medication( she is suffering from cancer), my sister in law called in her father to our house again and quietly and without any approval handed over to him , all valuables from the house including our Gold ornaments as well as hers. No body in my family was aware of this action of hers as we were assuming that all misunderstandings have been resolved and as the daughter in law of the house she was obviously not under constant watch because we had nothing to suspect.

In the same evening again her parents came to our house and said they want to take their daughter to their place for few days as she would be traveling to Dubai soon and they want her to spend some quality time with them before she leaves. My parents readily agreed to that as they were quite wary of her earlier misbehavior and did not want to refuse her any thing and trigger another incident . She packed everything in suitcases and took it along with her to her parent’s house . My parents obviously had no interest in her belongings and my sister in law left our house peacefully , with her parents and her belongings , amidst mutual expressions of goodwill and blessings . Her parents kept on saying that as she is going to her parents place, let her be with all ornaments some of which were belonging to my sisters and she was wearing it as she is the new bride and it is a bad omen to make the new bride remove any jewelry. They said it is matter of pride for you that you have done so much for your daughter in law .My parents are naturally trusting and GOD fearing elderly people and allowed her to go with all the things which were ours. She had picked up ornaments from my mother’s cupboard also for where we were not aware that time. She stayed one more month at her parent’s house and during that period we started receiving threatening and abusive phone calls from my sister in laws place that they will drag whole family in a legal case and that as they are very well politically connected they will make it happen through ministers and in fact repeatedly threatened my parents that they will create such conditions that both me and my brother will not be able to work in Dubai and will be implicated in cases in India and be dragged back to save ourselves and our parents. They will ruin our career. In response to that, being GOD believers we replied that GOD is there to watch all; He will take care of everything. At same time, they kept on calling us here in Dubai but we didn’t respond to them as they were using filthy and abusive language and had only threats to impart without any complaints or any reason for this sudden change in their behavior towards us. I being elder brother thought of solving the matter through our elder and reputed relative where he arranged a meeting via a mediator who had arranged the marriage (he is my sister in law Nisha’s relative). During this compromise meeting my sister in law accepted that she has taken jewelry and her belongings also, but also reconfirmed her desire to join her Husband (my brother) in Dubai at the earliest . During the meeting we called Nisha and asked her to move back to my parent’s house, which she point blank. Then we asked her courier us a copy of her educational certificates to expedite the processing of her visa. She said she will ask her brother to send it by post as soon as possible. They noted our Dubai address etc and we thought once again the matter had been peacefully resolved.

Without any further reason or provocation the next day , she lodged a complaint at the local Police station obviously full of false allegations about dowry, mental harassment etc and asked police officer to register a case against my brother my parents and my sisters , under 498 A.

Meanwhile, as a matter of precaution on our well wisher’s advise here , we have also filed a complaint through Indian Consulate clarifying our stand and the harassment suffered here which was sent to Commissioner and DCP, but unfortunately directed to the Passport DCP where that accepted and summoned from both parties but no action was taken as DCP passport’s office obviously don’t have any right of taking any action as the matter is beyond their jurisdiction.

From past 4 moths Police Officers at Nagpur have summoned my parents and sister several times to the police station along with Nisha and her father where they change their stand every time accompanied by convincing but false theatricals. Every time her father asks for various amounts of money and list of items which keeps on increasing with every passing day. As my father aged 73, mother aged 66( patient of cancer) and two sisters are absolutely helpless to handle the situation we were forced to consider compromising with my sister in law’s family even if I personally was against the idea as I detest blackmailers and liars, but as I am the elder brother of the victim and have had a brain tumor surgery in the past I can’t take that much tensions because of a fragile health hence I decided to give in to all their unreasonable demands. Almost everyday we are calling our parents and sisters to ensure they are OK and unharmed in India. My Sister in Law had taken our jewelry worth a huge amount. On the top of that they are asking us substantial amount as settlement money. We all family members are well educated. My both sisters are teachers; I am Computer Engineer, a topper and merit student in board exams. My brother is working here as β€˜Insurance Coordinator’ in Accounts for a medical centre. My wife and daughter both are here in Dubai with me. We have all gone through hell which you can understand without any fault of ours except that we trusted which is not really a crime. We keep on praying to GOD.

Now recently, Police Officer has registered a case under 489A against my parents, sisters and brother. I agree that the law should be there to protect the young brides against injustice ,unreasonable demands and torture by in laws but it should not be allowed to become an instrument of blackmail and extortion by unscrupulous girls , their parents, lawyers and police officers ,because thru this DRACONIAN LAW many innocent victims are being targeted , harassed and victimized.

Another Victims' Father Bites the Dust.

Just last Sunday Mumbai had its first meeting of victims.

It Included 6 Husbands and 1 Sister of a Victimised husband. Like I said that all the victims' stories sounded tragic, but today that is just 5 days later, the sister who attended the meeting sends me an SMS "MY DAD IS NO MORE, HE GOT MASSIVE ATTACK, FUNERAL TOMORROW..." on probing she sent me an SMS stating that it was all because of the prevailing tension of her brothers case... the father could not bear the shock and to add fuel to the fire were the calls from the Mother-in-law and Daugher-in-law for the Divorce.

More Details after I get the exact update from Donna, The Funeral will be at Holy Cross Church at 11.00 am, Kamani, Kurla West on 17th Sept 2005.

Members of the Save Indian Family expresses their Heartfelt Condolences to Donna Swamy, Philip and the family for this irrepairable loss. And sincerely pray to god for strength to the family to bear the Shock. May the soul of their father rest in peace.

Very sorry to hear this sad news. My heartful condelenses to the members of the family.

Some thing struck my mind when thinking about how many cases are being filed(misused) using 498A every day.
Correct me if I am wrong.
Instead of just we go by the number of cases filed and how many of them being misused, how would it be if we go like this.

per say, if there are 100 cases filed.
Out of these 100 say 60 are valid(where in the wife has been really harrassed), (Please be patient, don't think that, I am giving wrong numbers, I know this number is not correct).
So in these 60 cases, how many human beings are facing problems or harrased ? 60 , isn't it right?
Now in the remaining 40 cases where in the 498A is mis used,
How many human beings are forced in to problems and troulbes and harrassements by daughter-in-law, FIL, MIL, Police? Any guesses ?
At an average in every mis used 498A case, there are 5 human beings are facing this case, so

I would say not less than, 200 human beings. What would you say?
Am I wrong in this? Might be, if I am wrong, then the correct would be more than 200 innocent human beings are facing the problems.

So then who is suffering more? My point of informing this is, to tell any one(Women Organizations or Human Resources or News Reporters or the government) who says more number of girls are being harrased than the number of mis used cases. Show them this example and let us see what they say.

My case went all the way to supreme court and the
supreme court upheld & praised the High Court order.
Some of the learnings from my from my fight in Supreme
court and High Court.

1. Keep to the truth , complete truth and untwisted
truth. My oponent tried to twist the truth , mislead
the sequence of events and hide relevant facts. This
was to there undoing.

2. Be watchfull and carefull. Price of liberty is
eternal vigilance.

4. Be wary of tricks of oponenet and learn to
effectively use the www.supremecourt.nic.in site. I
made a mistake here . I knew there was 90 day period
of appeal but I did not know the procedure of filing
an appeal properly hence was searching on cases filed
on my or by my openent. I did not knwo that she has to
file against the state of karnataka and hence came to
know very late about this filing.I also want' sure
what name she would use to file since she has multiple
names

5. Be aware that there is a supreme court diary where
is cases can be filed before the expiry fo appeal
period and this can lull you into beliving that no
more you have to be vigilant. I almost fell for it
again . Daily you search if there is a diary pending
against you.

6. Caveat petition have a life of 90 days and they can
utilise the diary to get around the caveat by filing a
diary just before months with deliberate mistakes so
that another months can pass and bring it listing
after expiry of caveat petition is filed.

7. Daily search of supreme court is must for six
months . This would save you the exense of filing an
unnecessary caveat.

8. Finally should not hesistate to get advise of
mahesh Tiwari. He has got a very good grasp of the
working of the supreme court.His advice is worth in
gold.

9. I am taking advice from my lawyer before publishing
both the high court and supreme court judgement. It
will take a week and the high court is 50 page
judgement and has three important points of law whcih
are usefull for us . I haven't seen supreme court
judgment but it should be much smaller.

10. Finally it is important to engage a lawyer who
knows the case as good as you do and has ample time
for you .R L Patil my advocate in lower courts and
high court spent an enormous amount of time . So did
Basava Patil our Supreme Court Advocate.

11. This probably also signifies a shift in thinking
of the judiciary and realisation that they have to
protect the obviously innocent from unnecessary
harassment. I suspect that the larger number of
quashes and discharges reflect a realisation given
voice by supremec court PIL judgement filed by sushil
kumar. The PIL was definitely effective in conveying
the wishes of the supreme court and in my opinion a
successfull PIL.It is also reflection of the success
of our campaign.

12. We should continue the activism because unless you
let know you hurt people will not listen.

14. Internet media is proved for us to be effective
in spreading awareness amongst all the the people and
it is one area where we do have some degree of
leverage.

These frauds are taught by all the women's organizations and support groups in the USA to any woman who goes to them. All of these groups have lawyers guiding them along. These lawyers (men and women) advise them what to say (accuse their partners of domestic violence, etc.) in order to obtain US greencards. Most countries have laws to benefit women and women now know how to misuse them. Women's support groups are like trade unions and the remaining bastion of the communist party. I guess that the KGB might have funded them previously but nowadays they have created an atmosphere whereby they are obtaining Federal funds too. I am told that in India, it is even worse because the leader of the communist party is married to the leader of the women's movement (Brinda Karat) and they hope to come to power by using the women's movement.

which is behind a real cause? We are after eradicating
a real problem in the Indian society which is now
spreading like virus and we dont do unscrupulous
things like the women groups like sakhi and manavi do
in the name of women organization.

Day is not far when
- house wife will tell her husband who comes after
long day of work to cook food or face dire
consequences
- regularly send money to her parents (guys in laws)
or face dire consequences
- get beaten up daily by the wife and keep shut or
face dire consequences

I wish all those politicians who themselves support
this law to avoid women backlash and to avoid
propaganda from women activist groups. I wish of all
of them themselves go to Jail after their wife files

Ajay Nikam (28) was forced to sign divorce papers after his wife was allegedly abducted by a notorious criminal from Ahmedabad. His wife, Geeta (24), who was apparently in the gangster’s clutches, was also coerced to sign the papers.

However, Ajay and his family want Geeta back at any cost. β€œShe is a wonderful girl and has won us over in the little time she stayed with us. We want her back at any cost,” says Ajay’s mother Lata. Adds a distressed Ajay, β€œI will accept Geeta any day and at any cost, I am not afraid.”

Marriage without consent

The couple married on May 23, 2003, without her parents’ consent after a five-year courtship, and informed the family only in October 2004. But the love story took a tragic turn when Geeta’s parents, uncle Madhav Patel and aunt Kamla got gangster Babu Bajrangi to abduct her.

Geeta disappeared on November 30, 2004, a month after her parents were informed of the marriage.

After the abduction, Ajay received a threatening call from Ahmedabad asking him to forget Geeta. But a determined Ajay went to Ahmedabad, where Bajrangi’s men met him.

β€œThey told me, β€˜Aaj tera divorce hai,’ and took me to a place, assaulted me and at gunpoint, got my signature on the divorce papers. They brought Geeta also and got her to sign after they threatened to kill me,” says Ajay.
β€œI returned to Mumbai and approached the family court in Vikhroli, but there is no progress in the case.

The Tilak Nagar police supported me initially, but later discouraged me saying I should forget Geeta. I can’t even approach the Ahmedabad police as I think they are hand-in-glove with the goons,” adds Ajay. He has now approached the Gujarat High Court seeking its intervention.

But Geeta’s uncle Madhav Patel rubbishes the story, β€œBabu Bajrangi gangster thodi hain, woh to uska mama hain. Geeta apne mama ke paas hain, and it’s a rumour that she is married. We haven’t forced anything on her.’’

But a close relative of Geeta from Ahmedabad says that Babu has forcefully kept Geeta in Kutch, Gujarat, and Ajay would be killed if he came to Gujarat. β€œUse kehna, yahaan mat aana. Geeta wants to go back to Mumbai.’’

Who is Babu Bajrangi?

He is a prime accused of the infamous Naroda–Patia massacre after Godhra riots in Gujarat, in which at least 83 people were killed. Babu, however, got bail and also received a stay order on his trial from the Supreme Court.

Now I lost my faith in Indian judicial system. Once I left this counrty I'll never come back which i loved very much. But I think this place is full of corruption and bias. This is Sivakumar, who is facing problems with my wife and inlaws by rapidly going to police station and complaining and withdrawing for past 5 years, i have issued 2 times divorce notice.But they quited and made FIR by his Police influence and her last daughter is laywer misguiding my wife . My inlaw who worked in CBI making Blackmails to my family members by using harsh words and speaking about " Dowry harrassment" to my family members. Now still i am running my family on Black mail grounds and mental cruelty. i have already lost my singapore opportunity due to inlaw tortures and my career. Now i cannot able to concentrate on my career and already we lost money in taking Anticipatory Bail and court expenses to nearly 2.5 lakhs(all my father retirement money) .Still i am living with my " evil " wife who creates problem anytime under the instructions of his father Retired Police official and his sister lawyer at Chennai High court. Please give me suggestions and solve my problem and

Dear all,
This is an addendum to what I previously wrote about my current situation. As I had previously mentioned I am fighting a false legal case that was lodged by my "wife" if I can call her so any longer Namratha Annapareddy and her father Hanimireddy Annapareddy , who is the managing director for a granite firm in hyderabad Sri Vajra Granites.
I was just wondering today who people could be so vengeful and vain against some body whom they claim they once luved , just based on suspicion and false claims that even god cannot clear up for them. Just 'cos they suspect or feel something about the other person, they think they have the right to mis use the law in what ever connoted way that they can mould it up into. and 498A is definetly the weapon of choice. For father's who are shamelessly exploiting their daughters and daughters who are exploiting the fact that they are women.
Our best choice is not only to fight this leagally but also try to educate people about how stupid they are being for their own selfish motive.

If anyone here can answer this ? for me ... how can u try n harm some one whom you claim to ahve luved and lived with for years!!!!! Well atleast ic an conclude that my wife never luved nor is she capable of luving anyone.

For more than 3 years, I slog my ass off everyday for more then 10-12 hours and come home with the mere simple hope that I could relax and see aface that could pacify my day...but what do u get...at the end of the day a selfish , ignorant and totally vindictive girl who doesnt care about anyone else but her self!!!!! thats my wife for you guys!!! cant find anything more to describe her. I went thru this agony for 2 years , of living with a wife who is not capable of any compassion luving or caring. what make sit worse is Namratha wasnt even capable of taking care of her family or atleast what I supposed was her family me and her. With all the comforts at her disposal, unlimited access to everything she needed and wanted at the age of 25!!!!! nothing else to do no udnerstaning of what family means, no understanding or compassion of how other people live and feel, all she could feel was anger , ego and hate. And all of this with absolutely no remorse . Not sure how and when we can educate such ignorant people!!! I guess Never!!!

My only ? to her parents is " Is she really ur own daughter or did u find her some where and brought her up?? " 'cos if she was ur own daughter you would never do this to her or let her put herself thru this. No real father or mother would put thei OWN child thru this life of false claims and falsehood. Sir if I had a daughter who wanted to falsely accuse family(atleast once family) just 'cos she thinks she is entitled to.... i would rather throw her out of the house than keep her....again is she was my own blood and if I had a ny sense of being a father. Guys as I said again......the parents have to be educated....before there can be any changes in the Law of the land. If a family system has to survive in india, parents and people need to be more truthful and compassionate. Our legal battle would be a waste if we dont spread compassion among people.

I will fight this till my last breadth, if that means I am falsely implicated in this So be it. but I am not going give in to impassionate people. If my wife would have just told me that all that would have made her happy was to see me behind bars, i probably would have happily done that for her.....but for a human being (if I can call them so) to consider them holier than though and trample other peoples lives without any remorse.....man...they need a rude awakenning which they would surely get....

Atleast guys I'm not giving up!!!!!

hi i hv registered my email few days back and was surprised at
varous cases . right now i m gng thru serious problem with my wife.

im an NRI and i hv received a notice from my wife last week which
had all lies totally threatening for money, divorce and permanent
alimony and alleging abt harrassment and cruelty on me and my
parents. basically its a false notice with threat to take legal
action. i hv consulted a lawyer who has replied strongly to that
notice ( for a 3 page notice of hers, he replied with 8 pages )
denying all charges and asking her to apologise to me and withdraw
the notice within 7 days. this notice wil reach her tomm. i dont
know wht her reaction wil be. she is under some wrong influence and
her lawyer i got to know is a lady lawyer and has some political
influence. my issue is my parents are in india and i dnt know
whether she will harm them by filing a section 498a case.

my query is straight forward. as i said i can prove all her lies in
notice as false. is there anyway i can sue her for wrong allegations
as per her notice. can i come down to india and fight my case in
indian courts dismissing all her allegations.

whts the chance of winning based on facts and truth. but my lawyer
advices me of all dangers, women's laws, unfavourable environment
for these cases etc.,


one more doubt, how far emails can be used as a proof. i hv sm
emails which will prove many allegations of her as false.

The marriage of my client was solemnized with you on 11-4-2003 . It
was an arranged marriage. At the time of marriage my client's father
has given your father an amount of Rs.6,00,000/- (Rupees six lakhs
only) in cash as dowry. He had also presented gold ornaments of over
40 tulas to my client and also given you gold ornaments of over 6
tulas in the form of bracelet, chain and two rings. He had also
spent over Rs.4,00,000/- (Rupees four lakhs only) on other
lanchanams and marriage expenses.

At the time of marriage you were working as a software consultant
and were drawing more than Rs.75,000/- (Rupees seventy five
thousands only) per month as represented by you and your parents at
the time of marriage.


You had also taken an amount of Rs.50,000/- (Rupees fifty thousand
only) as hand loan from my client's father in a week after marriage
saying that you desperately needed that amount and had returned it
only after several months.


My client had again come to you with the tickets purchased by her
father in April 2005 with the intension of leading matrimonial life
with you. But you had intimidated my client that she would not be
living for long if she insisted to stay with you and you had
forcefully sent her back while allowing her to take only her
cloaths, but retaining with you all her gold ornaments with except a
chain and a ring. When she asked you as to why you wanted her
ornaments given by her parents, you told her that you had to incur
some expenditure on her and that the value of the gold ornaments was
much lesser than that expenditure.



My client had born all the humiliation and ill-treatment for long
with the hope that you would be changing one day and that she would
be able to share a happy life with you. But you had ruthlessly
belied her reasonable expectations by failing to care for her. You
and your parents are guilty of subjecting my client to cruelty for
want of additional dowry. You had deliberately denied my client
matrimonial life by failing to take necessary medical treatment for
your health problems. You had cheated my client and her parents by
not revealing about your health problems before the marriage and
thereby done great injustice to my client and ruined her matrimonial
life.

Under these circumstances you are hereby called upon to forthwith
ensure the return of the Rs.6,00,000/- (Rupees six lakhs only),
which was handed over to your father as dowry at the time of
marriage and also return the gold ornaments belonging to my client
and also those presented to you by my client's father and also
reimburse the amount of Rs.4,00,000/- which was spent on lanchanams
and marriage expenses. You are also called upon to agree to file a
petition for divorce by mutual consent and also pay to my client a
reasonable permanent alimony. Otherwise, my client will be
constrained to take necessary legal action against you and you will
be held responsible for all the costs and consequences thereof.

I sincerly look forward to responses from all memebers and if
possible through law community.

bible that " Its good to fight doing right, even if u have to
suffer, in that process, take it as blessing, as it says who can

Both for the victims and names of those women who hav misused it…..So tht any other person can know what these women are upto……..we’ve to move ahead as one and try to stop this misuse of this act… and I think u have done almost every step in doing so……. I want to take part in any activity which is possible by me in Hyderabad, on this issue.









THE STORY





My brother was married to this woman in dec 2k1.after marr which was completely arranged by my father and many dignitaries turned up and meanwhile his father-in-law was smoking and whiling away his time during the marr. After the marr bro has arranged for the visa and he left after 14 days … she immediately got the visa of course, after he left. Prior to his leaving he has specifically mentioned to everybody ,in the marr , in the reception, and after marr that he wud take his wife after six months due to the slump in the IT sector of US…. She hardly stayed with us and used to go to her home always and used to stay ther for a month or so…. After six months she leaves our home after fighting and filed a 498 case against us …..with the complaint of u might have idea of what these complaints are…. and the court has issued whatever they do… and then we were taken to the police station…… that day I’ll never forget in my life….. We have taken so much care that my mom never had to go to the market for anything …… but that day she was in the PS…. We didn’t know what was happening……… but by god’s grace we cud come out of those clutches……… but still we’re going around the bullshit courts which don’t seem to have an ear for us … they think that injustice was done to women and they take the women’s side and say u work it out………….. And they put up a lame excuse saying that law is in favor of them……. Then I wud ask what r we men for…….we’re into a situation what they were somewhere around twenty years back. So, coming back to the story…. after we got bailed out we approached the DCP of Hyderabad for the clearance of my mother or brother from the A1, A2 list…. But that person has summoned the women and asked for reconciliation. She said she wanted to talk to the husband not us…. Clearly an indication that she wanted my bro to come back to India……. But to our astonishment even the DCP has asked us to reconsider about the reconciliation….. and then she says... tht we hav taken nude movies of hers…….. then the DCP warns her after an argument. But to no use he doesn’t remove my bro or mother from the list... then the usual story of the court.after three yrs my bro has returned frm states and his passport was impounded... judge went on leave for two weeks……. And then she returns and now she has included us in the list me and my father………… but after we confronted the judge in the court she has asked us what ….. my dad spoke up and told her that my bro has come to be present before the court... and now his job is at stake…. My bro was asked by her for his opinion about reconciliation……. He said no in the court itself and he cited her allegations against my mother as reason for not taking her back …. She later after so much convincing she has issued his passport ……he has divorced her in US, but in India she said that she was having asthma (new excuse… but I think we can use that reason for divorce……please advise on this regard too) and dint turn up to the court when my bro was here….now the trial starts tomorrow …….

I have some new information to add in my ongoing 498A/323/114
ordeal. My delhi lawyer got a copy of the FIR from the Delhi police
station. It says 498A, 323, 114 against myself and my parents. Also,
their clever lawyer has taken care of the jurisdiction issue (I stay
in B'lore, she stays in Pune, her parents stay in Delhi and FIR was
filed in Delhi) by saying that me and my parents went to delhi few
months back, harassed them for dowry and forcibly took away the
child. And that we also went to Pune and harassed her there also for
dowry!!!!!. I never imagined they could cook up all this blatant
falsehood against us. We are dealing with a very strong, cunning,
cruel enemy.

Few months back, I had indeed gone to Delhi but it was to bring my
son to B'lore for his summer vacation (after bringing him here I had
refused to send him back). They had had agreed that I could take him
on the one condition that I had to return him back to delhi after 2
months. Again, after bringing my child here and before all this mess
started and when we were still on talking terms, I had gone to Pune
also because she had asked me to come there for her operation.
They've twisted these two instances to suit them.

My lawyer says it will take atleast a week to get AB. Tomorrow is a
holiday for them and he would file it only on friday. It is already
4 days since the police came to my house. I am scared whether this
delay will adversely impact our chances of getting AB. Please
advise. Also, I have the following questions..

1) After getting the AB, should I file a case for quashing it?
2) Can I file for getting a stay on personal statement recording
from police since I am far from the police station.

3)Could you also tell me what are the sections that I can slap
against them after I get the AB. Obviously, malicious prosecution,
Defamation, False charge of offence made with intent to injure,
Divorce and custody petition. How much will all this cost me????

avoid further harassment. But I am determined to fight to the last.
She cannot take my son away from me. It is not conducive to his
welfare and wellbeing. I have the following questions:- 1)Can she
file false dowry case even after completing 8 years of marriage and
a 7 year old kid? 2)Can she file it in Delhi even though she is
staying in pune and I am staying in B'lore? 3)Is there anything else
that we can do other than applying for AB 4) How to stop her from
harassing us again.

My wife's affairs with my long time close friend in Dubai came to my
attention, as I caught her red-handed when she traveled alone from
Abu Dhabi to Dubai to meet her partner on 23rd April 2005. I have
recorded her mobile conversation with her partner, and found letters
written in her own hand-writing that revealed her close and deep
attraction towards this man. My daughter (13yrs) had also confirmed
her mother's involvement. when I had confronted my wife, she admited
her fault. When I left her with her parents in India, and sought
divorce on mutual grounds, she first agreed, as I too wanted to save
their fsce in society by not divulging actual reason for divorce.
Instead, she filed, rather forced, police to accept her FIR under 498
(a) agiast me. I was arrested at the airport like a terrorist while
I was leaving for my job. I surrendered to police, and was put
behind bars. I had absolutely no idea what is IPC 498(a) and it's
consequences. I explained the police whole story and showed
her letters and audio tapes, my children / relatives also visted
poilice station. My children ( daug. & son ) were horrified to see
me in the jail. BUT, by the grace of God and good karmas, I could
get bail, and permission to request for passport and return to work,
which I could get- A Miracle! My children are under my safe custody,
and to prove that I will cooperate with Court/Police for
investigation until proven innocent, I had to putup my children in
India for their study.I have filed a case of divorce & custody of
children in family court in bandra-Mumbai. Since onus is on me now,
I am going through hell to attend courts from Abu dhabi, on & off,
also look after my private job to retain it, and pay attention to
children welfare!?? I have dates in Criminal court in coming months,
I have hired a lawyer and given him all the evidences I have such as
letters, audio recording etc. I have also attended charge sheet
filing in the court. My trial has yet to began. SOS: Could someone
tell me what are my chances of survival!? We are married for last
16 yrs. I am NRI for last 14 yrs. No bad habbits. I never took
dowry. In fact, I hv given many gifts, financila supports to my in-
laws. I am spiritual oriented person under blessings of Sai Baba
doing many charity works, and good reputation in society. I am
engineer working in oil company. My children do not want to see face
of their mother as they know that she was having un-acceptable
behavious with her partner, and are scared that she could harrass
them. They are ready to testify in the court against her. My friends
in Abu dhabi are supporting me, and some of them have agreed to
testify. ANY SUGGESTION FROM EXPERTS WILL GREATLY HELP ME TO SAVE
MYSELF SO THAT FUTURE OF MY INNOCENT CHILDREN IS NOT DAMAGED. I want
to fight this case to inspire many such innocent men who are being
punioshed for no fault under utter misuse of this law 498(a). PLEASE

My son has left for abroadfor pursuing higher studies and a fals case has been registered against him including my self and my wife. The girls parents have also grabbed my property by force and foul means. They have charged us that we were demanding money for sending our son for U.S.A.while he left for U.S.A. four months before rom the date of filing the FIR. If you and your family have been wrongly fabricated in dowry harassment case by
your wife, then ask for Lie Detector Tests like Narco-Analysis Test and Brain
Mapping Test examination of your wife. These tests will prove the authenticity
of her charges. Very recently these test have shown the correctness of their
methods and revealed all the lies of accused Preeti Jain in the Madhur
Bhandarkar case. You can send a request application for the above tests to DGP
of your city with a copy to others, who usually have the authority for ordering
these tests.



After greatly harassed by my wife’s consistent lies and false blames, I had
requested the honorable judge during my interim bail hearing on 24th Oct 2005 at
Jaipur High Court to order for Narco Analysis test and Brain Mapping Test
Examination for my wife who has accused me for dowry harassment and other
tortures. I requested to the judge that all the facts related to this case shall
be revealed to the Law and court and I am confident that I am innocent in this
case, and she is still saying that I demanded dowry and went to her house with 2
gundas on 6th March 2005. But actually i was journeying from Jaipur to Mumbai on
that given time and date in the FIR, for which police has already conducted the
investigation on the basis of train tickets and reservation chart. Even I have a
SAB TV recording in which my wife said that "ye ek kamyab pati hai, aur inhone
mujhse isliy shadi kari kyoki mei thik se English bol pati huo". There are also
other strong evidences to prove my innocence. So I
requested to examine me and my wife Sarita on the lie detector tests that will
unveil all facts of the case. If such tests would be conducted in dowry related
cases then all the wrongly manipulated cases related to dowry harassment will
come to an end. There should a stringent punishment to a wife who misuses the
laws, for perjury and for playing with the sanctity of law authorities, police
administration and blackmailing husband and his family members and breaching
their trust.



Next hearing is on 9th Nov 2005, when the high court's final judgement on my
Anticipatory Bail application is expected



This kind of Human Rights Abuse against husbands is on high rise in India and
have become a topic of common talks to an extent that it is being covered by
many TV News Channels occasionally but still many husbands and their families
members that include old father and mother, and brothers and sisters are being
jailed without even doing any kind of investigation, but just on the basis of a
complain by the wife. Many NRIs, Doctors, Engineers and other professionals
including their families had been jailed without proper investigations. It is
mostly seen that such cases get finally trail down to a compromise in between
the husband and wife, and due to the strong legal position and major privileges
given in Indian Law to a woman, wife enjoys uncontrolled decision making powers
that are used to blackmail husband to extort money, jewellery and to make him
accept her unjustified demands. In most of the cases, wife seeks a divorce from
husband after getting a big amount as Alimony for
withdrawing all her cases. Many families are suffering great financial, social
and mental losses due these easily excisable frauds. Laws like sec. 498A and 406
of IPC have generally become the tool to extort money from husband's family to
pressurise them for agreeing wife's demands.



Harassed husbands feel that even being innocent in such cases, on one in public
administration can help them as every one is afraid of propaganda by women
organizations who chase government funds. These victims of misuse of dowry laws

1. To bring dowry act and cruelty laws under civil laws.
To make 498a bailable.
To replace the word 'husband' or 'wife' with 'spouse' in all related laws, so as to ensure equality in law for men & women.

Rational arguments to support our demands:

--Present treatment of dowry and cruelty under criminal laws is not effective. It is destroying the institution of marriage itself.
--Sending thousands including women and children to custody, even though almost everyone agrees that most complaints under 498a are false and 98% result in acquittal.
--Once husband/family have been arrested, the chances of reunion are very low. Thus, even if a complainant realizes her mistake and wants to return later, she usually cannot.
--498a is a potent weapon, which is often misused by women to wreak havoc on husband’s family and by police to make money.
--These laws have not served the purpose of protecting women, as because of a complaint by one irrational woman, several women in in-laws family are put to extreme suffering.
--It will reduce workload on the criminal courts and thus help in speedy trial for all. Government itself and various others are trying to achieve this.
--Protect our privacy by stopping intrusion of police in our homes/domestic affairs. Almost all civilized societies domestic disputes are covered by civil laws.
--Fear of arrest is biggest weapon in hands of police, which they often misuse to earn extra money.

2. To make registration of marriages compulsory.

Rational arguments to support our demand:

--At time of registering declaration will be made that no dowry is taken or given, since dowry taking or giving is against the law anyway.
--A list of gift items will be prepared and signed by both sides.
--Registering marriages also will make sure child marriages are stopped.
--It will also stop tricking someone into marriage by some people.

Will it stop allegations u/s 498a?
--By law, it may not stop 498a cases, as by definition 498a is about cruelty, which does not have to be related to dowry.
-- But generally people associate 498a with dowry, so it might help discourage people from filing 498a.

3. Fair and impartial police investigation
--Discourage false complaints
--'No arrest' unless absolutely necessary

Rational arguments to support our demands:
--Fear of arrest is the biggest weapon in hands of police.
--When a law-abiding citizen is faced with a probable arrest due to false allegations, he goes through extreme mental agony.
--This fear of arrest is used by complainant to "legally blackmail" the accused and his family.


--Meet police commissioner and other high-ranking police officers
--Invite police officers to group meetings.
--Understanding their approach to investigations and suggesting modifications.
--To keep police within established guidelines for handling dowry cases.
--Action on I/O’s who do not comply with police department guidelines.
--Possibly getting into proactive engagement with CAW cells & police stations.
--Clarify--several people reported that CAW cells are not providing copy of complaint.

4. NRI Issues

--No 498a complaint should be permitted to be filed in India if matrimonial residence is not in India.
--No LOC in dowry cases.
--No denial of consular services like passport renewal, attestation etc by MEA/Consulates abroad.
--Someone who is familiar with NRI issues and understands NRI specific issues should investigate Complaints against NRI’s.
--Exemption from personal appearance in courts. Trial trough video conferencing to be permitted routinely.
--Stop harassment of NRI's families in India who have hardly ever lived with the married couple.
--Facilitate return of NRI to India to face investigation, trial etc by assuring speedy trial, no confiscation of passport by courts or restriction on travel abroad.
--Maintenance awarded to wife in India should be in accordance with cost of living index in India, not solely based on husbands income in Dollars.
--A NRI cell could be created to handle these investigations.
--A Magistrate could be designated to handle NRI dowry related cases. This court can be equipped with video conferencing so that physical presence is dispensed with. (This is allowed by Supreme Court). It is feasible.
This special court should be the only one authorized to take cognizance for offences under 498a/406 etc. This way cognizance would be taken (FIR registered) after evidence is recorded in court. Just a baseless complaint will not be enough, like it is now.

Rational arguments to support our demands:

Action Plan:

--Seek clarification from MEA regarding LOC, passport services at consular offices and pursue changes in accordance with our demands.
--Develop strategy to put pressure on Indian Government for reform of dowry laws from abroad.
--Stopping FIR's where couple did not live in India for most part and stopping cases against their families in India.
--Meet Home minister, NRI minister and seek fulfillment of our demands.
--Seek judicial changes, judicial precedents in laws adversely affecting NRI's.

5. Stop elder abuse

--Only officer above rank of ACP should investigate Allegations against elders.
--Elders should not be unduly harassed during investigations.
--Our mothers and fathers should not be disgraced just because we made a bad choice in marriage.

Campaigns

Political Campaign:

Any changes in law can only be made by the Rajya Sabha/Lok Sabha. Someone who is a member of these legislative assemblies must introduce a Bill for amendment and the bill must be passed by a majority.The Law commission of India can also recommend this Bill to the legislative assemblies.Than it will be notified by the Government and will come into force.
--To get someone to raise the issue and introduce the bill in assembly.
--We must provide information and data to MLA's/MP’s. We will do this on both local level in the constituencies and than subsequent follow up in Delhi.

A.preparation of pamphlets for distribution
--To local MP's by people in their constituencies
--Follow up with same MP's by people in Delhi.

These pamphlets will:
--Outline our problems.
--Provide data on misuse & abuse of dowry laws.
--Provide enough material for an MP to be able to raise the issue with confidence in parliament

Media campaign:
--Create awareness in public about our goals by developing strategies and using media effectively to bring real stories behind 498a and crime against women
--Highlight on breakdown of families specially elders
--Anti-dowry laws are against women
--Sympathy for falsely accused families
--Stigma should be on false accuser.
--Compile news articles.
--Compile past achievements.
--Write action plan/media strategy.

Judicial Campaign:

--Counter cases should be allowed by courts liberally against cheating wives. Even one wrong allegation should be enough for judge to initiate an inquiry against the person filing frivolous complaint.
--Speedy, just and fair trial. Courts treat us like criminals, we are only 'accused', most likely to be acquitted.
--To get acquittal under honorable acquittal and not under benefit of doubt, as is the case presently.
--This will help us generate realistic statistics as to how many cases were probably false
--Help in filing defamation, counter cases, suits for damages after case is over

can somebody please help me. i am an nri. i am staying in u.k. i came to u.k in the year 2002. i married in 2003. After 15 days i came back to u.k. i tried to bring my wife here but she is not willing to come here. After that i went to india for 15 days holiday. Again i tried but she did not get the visa. Afterwards i came to know that she did not want to come with me. she want to stay in india only. she is very much jelious. she started torturing me with her too much jelious. she does want me to even talk with anybody. she can not even bare if i talk to me parents in the phone. she tortured me with her swaring words in bedroom. And also she is not allow me for romance when i went to india for holidays. but i did not tell to anybody (not even my parents). Recently i decided i can not stay with her with life long. i went to india in august 2005. i talked with her parents. They told me that we did not my daughter with you. you go and do your job. After that i came to u.k. Now i came to know that they put dowry harrasement case against me and my parents. i was not in india for not more than one month with in these two years. how can i harres phisically her. i do not know what i have to do. i am totally confused. please somebody help how can i face this situation. And also help me to save my parents. please........

Sir,
I am a victim of 498a, 406 and 3/4 dowry prohibition act. My wife was misguided by her parents and she had filed false case against me after knowing the civil case filed by me for restitution of conjugal rights.
In short,
Marriage was held on 8.12.03 at Patna, she comes to my home in Gaya after marriage and stays for four months. Later she was taken by her parents to her parents home to make her appear BA-III examination. She continued her computer education for another 1 year. In the mean time I had visited her twice to take her to Delhi, which she and her parents refused. Later I filed a case in Dist. Court Gaya seeking Resitution of Conjugal Rights on 17.Oct.2004. Two months, later I was summoned by Patna CJM for 498A, 406, 3/4 Dowry and five members of my family were implicated including me, my parents, Didi and Jijaji.

Anticipatory bail was granted to Didi and jijaji from Session Court.
In High Court, during anticipatory bail, The Judge asked to appear both wife and husband in the court. Her father had asked for Lumpsum amount in High Court during bail proceedings, which High court rejected. Later 20 mintues of time was given to wife and husband to find out possibility of restoration of marriage. Which finally, she agreed to join her marital home. I took her to Delhi. A judgement of STAY ORDER for three months on 498a, 406, 3/4 dowry act was granted as an interim relief from the court.
3 months later, she compromised in the Lower Court, and then supplement compromise was also filed in High Court. but her parents were not in favour of compromise.
4 months later, when I was in Patna for surrendering in CGM Patna after anticipatory bail, she was forcibly taken by her parents to her parents home. I am afraid, if she can be again misguided by her parents.

Please help me what should I do? Is there any NGO working in Bihar could counsel her and her parents to join marital home?

After marriage(as per hindu rites), my wife stayed with me and my parents for a week. After that I left for abroad after which she joined me after 3 months. We stayed together for 15 months in aborad.During this period she mis behavoued with cruelty (scratching me with her nails no of times and abused to my parents). when I tried to inform her parents the same they threatened for false dowry case. I complained about them in the police. Then we agreed upon divorce. We can\'t file mutual consent petition till we complete one year of separation. They forced me to file false petition I did not do it and asked them to wait till we complete the separation of one year. She did not agree to that and filed a FIR against me and my family under sections 498A/406/504/34. I am in abroad currently when she filed a complaint. Now her lawyer has sent us a letter asking for large amount of money for settlement (seems a leagal blackmail). Please advice.

Sir, As described by others we are very good and harmless middle class people living in chennai. I am eldest son of my family. My father & mother are aged people. My sister marreid having two children, Me also married two children. On Feb 18th 2005 we conduct marriage on our own expense as in practice in our community for one of our younger brother after that we came to know that we have been cheated by the bride and bride family that the lady had undergone a open heart surgery
and she is heart patient. Before or on the marriage day no one revealed to us. Hence,we filed a complaint in police station about the fraud and they try to compromise due to their influence and one day on May8th they came with all thier people and weapons assaulted all of us, again we filed a complaint on them. Then the people were arrested and then we file a Divorce Case on 13th May 2005. On receipt of the information those people made false dowry arrassment complaint back dated i.e frulous and try to harass us. The court also ask us to present to hon'ble court. We file quash against the false complaint but rejected by court stating that prove our innocense thru' trial only. Even we tried in Supreme Court again rejected. Now we filed for review there also we are bad luck people. My father is 73 years old and mother over 50 years. My sister married having two children and she is living with her husband separately. I am also living separetely with my wife and children. My younger
brother and bridegroom are living with our parents. In our community there is no dowry practice so far. And also bridegroom is responsible for conducting marriage etc. All expenses are bourn by bridegroom family only. It is a common practice in our community. But the bride filed a false complaint against all of the seven people in our family including me, my sister and brother-in-law who are not living in same home where my parents living. Nowadays all parents whom having male child should be very careful to select bride for their son's.Otherwise let they just drop their son's out of home and ask him to live in his own style if he want marriage let him select whoever it may be let marry her and live separately and leave elders and in laws live peacefully and respectfully. Please ladies don't take this act as your weapon to fullfill your needs are to utilise complete your vengence. So many elders in india are nowadays affected by this law without commiting any mistakes.

Dear Editor,
Through the columns of your esteemed news paper, I would like to bring to the attention of authorities and mass public as to how the section 498A of IPC (Indian Penal Code) is being misused to extort money from NRIs. Here is my story which will resonate with thousands of people in US.
I came to US after completing graduation from IIT and completed higher studies from one of the top 5 schools in US. Have been working as a Scientist in a top US firm. Two years back I went to India and got married (Arranged marriage). As soon as we came to US, I realized that the only reason my wife married me was to get a US visa and enjoy american life. Unfortunately the life in US is not as glorified as people think. As such she went back to India and filed a 498A case against me and my family. The complaint is -
1) I asked for a dowry of 20lacs. Does it even makes sense for a person earning 50lacs+ to ask a dowry of 20 lacs?
2) That she had to sleep on floor when the relatives were visiting. - How else will you manage in a 1 bed room apartment. What she failed (intentionally) to mention was that everyone else in the apartment was also sleeping on the floor.

Now she is willing to compromise if I give her 50lacs. This is becoming a common story and as far as I know, the same thing is happening with almost 5% if IITians.

We talk about brain drain. How can we expect the elites to come back to their country when we have such laws in place.

In my case she went even further by stating that my parents used to sleep in the bedroom and that she was forced to sleep on the floor in the living room (when in fact the opposite happened). She also stated that she used to cook breakfast for my parents by getting up 6 in the morning, come back from office before lunch to cook lunch and then come back from office in the evening early enough to cook dinner for all of us - when in fact she used to get up 8 in the morning, come back from office by 9 by which time the food was already cooked and my parents already had dinner by then because they are used to eating early.

I got married one years ago .It is an arranged
marriage. My wife and her family members pressure on
me to leave my family and I have no contact with my
family members , My wife makes pressure on me by
attempt to suside . They plan to use / misuse the
dowry act. I am scred of that.
